Introduction
This Privacy Notice explains how the Peyronie's Disease Self-Assessment Tool ("Application," "App") owned and operated by Endo USA, Inc. ("Endo," "we," "us," "our") collects, uses, and shares personal information ("PI"). For the purposes of any processing activities subject to the EU or UK General Data Protection Regulation ("GDPR"), Endo is the controller of your PI.
Scope
This Privacy Notice describes the PI collected through the App, why the PI is collected, and what the PI is used for. This Privacy Notice does not apply to PI that is collected or shared by any third-party website or service that you access through our App (including, without limitation, the SMSNA and ISSM).
Sources and Types of PI (personal information)
All PI uploaded and/or generated through the App will be stored on your device and the App only. Endo will not have access to any such PI.
PI will only be collected via the App in the following scenarios:
- Once you download the App on your mobile device, you will be prompted to create a password or to authenticate using your fingerprint or facial recognition in order to maintain security of your PI. Setting a password or fingerprint/facial authentication to access the App is optional.
- The App allows you to complete an optional, short self-assessment questionnaire. The questionnaire contains 11 questions and sub-questions based on responses. The questionnaire asks general questions in order to potentially detect any symptoms of Peyronie's disease.
- The App may request access to your phone's camera in order to receive a curvature measurement based on a simulated image. An additional image is taken against a measurement scale.
How we Use your PI
Your PI is processed via the App in reliance on your explicit consent to provide screening and detection information related to Peyronie's disease.
Your Privacy Rights:
Although we collect none of your PI through the app, if you have questions regarding your privacy, you may contact us as indicated in the How to Contact Us section. We will respond to your request consistent with applicable law.
EEA/UK Residents: If you are located in the EEA or the UK, you have certain rights in relation to the processing of your PI which are subject to certain limitations/exemptions. These rights include: (i) a right to access, rectify, or erase your PI; (ii) restrict or object to the processing of your PI; (iii) withdraw your consent to the processing of PI; and (iv) request that your PI be transferred to a third-party controller. As stated above, all PI is held locally in the App on your device and we do not have access to the PI. Please note that all PI collected and generated through the APP is accessible via the App. You can amend responses to the questionnaire via the App and if you delete the App from your device, all PI contained in the App will also be deleted. Separately, the App has a feature that allows you to use your personal email address to send the questionnaire results, simulated image with curvature results, and an additional image with measurement scale to the provider of your choice. To send the email, you must exit the App and attach the results produced by the App to the email. It is your responsibility to confirm the provider's contact details and confirm the "send from" email address before sending an email that may include PI.
You also have the right to lodge a complaint with a competent supervisory authority.
California Residents—the following is provided for your information. Be advised that the PI is only on your device and is not shared. When you delete the App, your PI is deleted.
Your Rights to Request Access to and Deletion of your Personal Information: Under the California Consumer Privacy Act ("CCPA"), California consumers, subject to certain exceptions (including the Personal Information collected in the App for Peyronie's disease), have the right to request access and deletion of PI collected, used, transferred, disclosed, sold, or processed by Endo. The Personal Information you provide related to Peyronie's disease is not available on any Endo servers and is stored locally in the App. Subject to proper validation, you can:
- Request confirmation as to whether Endo has PI relating to you.
- Request access to your PI that Endo holds on you, including:
- the categories and specific pieces of PI that Endo has collected about you;
- information about the sources of collection;
- the business or commercial purpose for collecting your PI; and
- the type of third parties with which we share your PI.
- Request deletion of your PI.
You can make such a request by emailing privacy@endo.com or by calling us at (800) 462-ENDO (3636). Please include your full name, mailing address, email address, phone number, date of birth (month, day), relationship to Endo (eg, former employee, healthcare provider, patient in a clinical trial), and type of request (eg, Request to Know/Access, Request to Delete). We will provide a response with the required information free of charge within 45 days of receiving a verifiable request (with an additional extension of 45 days if reasonably necessary). You may request this information free of charge up to two (2) times in a 12-month period.
We may request additional information from you in order to verify your identity and confirm that the request is valid. The information we require may vary depending on your relationship to us. If we are unable to verify your identity using this process, we will provide you with an explanation and describe additional steps you may take to assist us in successfully verifying your request.
If you request deletion of your PI, we will assess the request to confirm whether there are any reasons for which we are required to retain the information about you, including for specific business purposes, to fulfill a legal obligation, or other reasons permitted by law. If we are not able to service your deletion request, we will provide you with an explanation.
We Do Not Sell Your Personal Information: Under the CCPA, California consumers have the right to request that their information not be sold for value. Currently we do not and will not sell or disclose your information to third parties for monetary or in-kind compensation; however, if this practice changes in the future, we will provide updated information via this Notice and provide instructions on this page on how to submit a request to stop selling your PI. In that event, you may also request, free of charge, a list of the third parties (if any) to whom we have disclosed your PI for direct marketing purposes within the prior calendar year, as well as the type of PI disclosed to those third parties.
California consumers also have the right not to receive discriminatory treatment from the exercise of these rights. Endo will not discriminate against you for exercising your rights under this Notice.
How we Store your PI
Any PI captured within the App, including responses from the self-assessment questionnaire and the App's scanning feature that produces a simulated image, are stored locally within the App and on your device. Endo does not have access to any data or PI stored in the App. PI is never stored on Endo servers, it is never backed up, and it cannot be used or accessed by Endo or its affiliates.
How we Share and Transfer your PI
We do not share your PI as Endo cannot access it. Your PI is not transferred to Endo, its affiliates, or its service providers.
How we Protect your PI
We implement appropriate technical and organizational measures to safeguard the PI in the App. Unfortunately, however, no safeguards are foolproof. Your use of our App is at your own risk. You are responsible for maintaining the security of any password you create for the App. If you forget your password, simply delete the App and re-download it. There is no password recovery.
Retention of your PI
Your PI is stored and retained for as long as the App is downloaded on your device. Once the App is deleted/removed from your device, your PI will also be deleted. While the App is still downloaded on your device, the PI will be retained.
The App is Not Intended for Children
You must be at least the age of majority in your place of residence to use the App. The App is not directed to or intended for use by minors. Consistent with the requirements of applicable privacy laws including the U.S. Children's Online Privacy Protection Act and the GDPR.
Links Provided by Third Parties
The App may include links to third-party websites including the Sexual Medicine Society of North America, Inc. ("SMSNA") and the International Society of Sexual Medicine ("ISSM") intended for the provider look-up. The SMSNA website is not operated by Endo. When you click the "Locate a Provider" link, the third-party website will automatically launch in an external page outside the App. A link to a third-party website or service does not mean that we endorse it, or the quality or accuracy of information presented on it. By locating a provider provided by SMSNA or ISSM, you are subject to their privacy practices, policies, and disclaimers. This Privacy Notice does not apply to any PI that you provide to these other websites and services.
Changes to this Privacy Notice
The effective date of this Privacy Notice is set forth at the top of this page. We reserve the right to change our Privacy Notice as business needs or applicable laws require. If Endo makes material changes to the way we use PI, the App store will contact you via your App page on your device that a new update to the App is available and you will be asked to re-consent to the processing of your PI. The revised Privacy Notice replaces and supersedes all previous versions.

Not Medical Advice
The Content within the App related to Peyronie's disease is for informational and detection purposes only. Please confirm all Content with other sources and with your urologist and professional healthcare providers. We do not warrant or guarantee any treatment, therapy, medication, device, diagnosis, action, recommendation, or strategy of any author or other person available through the App.
THE INFORMATION IN THIS APPLICATION AND ITS CONTENT ARE FOR INFORMATIONAL PURPOSES ONLY AND NOT INTENDED AS A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. DO NOT DISREGARD, AVOID, OR DELAY OBTAINING MEDICAL ADVICE FROM A QUALIFIED HEALTHCARE PROVIDER BECAUSE OF THE RESULTS YOU MAY HAVE READ THROUGH THE SITE. Disclaimer
Endo offers the App (which, for clarification, includes Content) for informational and detection purposes related to Peyronie's disease only. Although we try to make sure that Content (including curvature measurements) is accurate, we cannot and do not guarantee its accuracy. Curvature measurements may vary by up to 20 degrees.
The App should not be considered as a replacement for consultation with a urologist.
While Endo has endeavored to make sure that the App is accurate, Endo does not and cannot guarantee the accuracy, completeness, or reliability of the App. Your use of the App is at your own risk. Endo does not warrant that the App is accurate, complete, reliable, or error-free.
THE APPLICATION IS PROVIDED AS IS WITHOUT WARRANTY OR GUARANTEE OF ANY KIND, WHETHER EXPRESS, IMPLIED, ORAL, WRITTEN, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND/OR NON-INFRINGEMENT. Endo's goal is to help make certain detection information related to Peyronie's disease more readily available and useful to you. However, the App cannot and does not guarantee health-related improvements or outcomes. Your use of the App and any information provided in the App are at your own risk.
Use of the App
Any Personal Information ("PI") you submit through the App is governed by Endo's Privacy Notice.
By accepting these Terms, you agree not to use the App for any purpose that is prohibited by these Terms. You are responsible for all of your activity in connection with the App and you shall abide by all applicable local, state, national, and international laws and regulations, and any applicable regulatory codes.
Registration and Passwords
To use the App, you are not required to create a user account. Once you download the App on your mobile device, you will be prompted to create a password (minimum of six (6) characters) or to authenticate using fingerprint or facial recognition in order to maintain security of your Personal Information related to Peyronie's disease. Setting a password or fingerprint/facial authentication to access the App is optional. You can manage your password and fingerprint/facial authentication when you are still in the App. If you forget your credentials, simply delete the App and re-download it. There is no password or fingerprint/facial authentication recovery.
You are responsible for taking all necessary steps to ensure that no unauthorized person shall have access to your App passwords or account.
Children
The App is not intended for use by children. We do not knowingly collect information from or about children.
Use of Mobile Devices
While using your mobile device (iOS or Android device) to access the App, please note that your carrier's normal rates and fees, such as text messaging and data charges, will still apply.
Links to Other Websites
The App may provide access to other websites, including the urologist look-up feature provided by the Sexual Medicine Society of North America, Inc. (SMSNA) and International Society of Sexual Medicine ("ISSM"). Links to other websites are provided only as a convenience to our App users. We cannot guarantee and do not monitor the content of any website to which we provide a link or reference. The inclusion of a link does not imply endorsement by Endo of the linked site or any association with the operators of the linked site. Endo does not investigate, verify, or monitor linked sites. You access linked sites at your own risk and subject to the legal provisions applicable to the linked sites. Endo has no liability for any alleged or actual damages or injury arising from a user's access to linked sites.

Endo is committed to respecting the privacy of our App users. Please see our Privacy Notice for more information.
Changes to these Terms
The effective date of this Privacy Notice is set forth at the top of this page. As we add new features, we may amend or supplement these Terms. If Endo makes material changes to the Terms, the APP store will contact you via your App page on your local device that a new update to the App is available. Your continued use of our App after the effective date constitutes your acceptance of the amended Terms. The amended Terms supersede all previous versions of or agreements, notices, or statements about the Terms.
Termination
You may stop using the App at any time. We also may stop providing the App or create limits on use of the App, whether specifically to you or generally. These Terms automatically terminate when you fail to comply or if we reasonably believe that you have not complied with any term or condition of them. Termination will not limit any of our other rights or remedies. Any provision that must survive in order to give proper effect to the intent and purpose of these Terms shall survive termination.
General Legal Terms
- These Terms which incorporate our Privacy Notice contain the entire understanding by and between Endo and you with respect to the App.
- Your affirmative act of using the App and confirming the Terms on the welcome acceptance page constitutes your electronic signature to these Terms and your consent to enter into agreements with us electronically.
- Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Waivers are effective only if in writing and signed by us and you.
- If any provision of these Terms is or becomes unenforceable or invalid, the remaining provisions will continue with the same effect as if such unenforceable or invalid provision had not been used.
- Nothing contained in these Terms will be deemed to constitute Endo or you as the agent or representative of the other or as joint venturers or partners.
- These Terms inure to the benefit of and will be binding upon our and your permitted successors and assigns.
